This Privacy Policy describes for you the information Scientific Toolworks, INC ( “Scientific Toolworks”, “SciTools™”, “we”, “our”, or “us” ) collects, how that information may be used, with whom it may be shared, and your rights and choices about such uses and disclosures, and applies to your use of any online service locations that posts a link to this Privacy Policy, including our websites, apps, software offerings, and all features, content, and other services that we own, control and make available through such online service location ( collectively, the “Service” ). This Privacy Policy does not apply to our information collection activities outside of the Service ( unless otherwise stated below or at the time of collection ).

We encourage you to read this Privacy Policy carefully when using our Service. By using the Service, you agree to our Terms of Use and accept our collection, use, and disclosure practices described in this Privacy Policy. If you do not agree and consent, discontinue use of the Service.

2. Information Collected About You.

Section A – Information you provide

We collect information you provide directly via the Service. For example, we collect information when you, register an account, fill in your profile, sign up for a subscription, participate in a promotion or survey, contact customer support, place an order in our online store or otherwise communicate or transact with us through the Service.

Name and Contact Data: We collect your first and last name, postal address, e-mail address, telephone number, and other similar contact data.

Section B – Statistical Information About Your Visit.

We automatically collect certain information about your device and how your device interacts with our Service:

Log Information: Log information is data about your use of the Service, such as IP address, browser type, internet service provider, referring/exit pages, operating system, date/time stamps, and related data, which is stored in log files.

Cookies: A cookie is a small text file that is stored on a user’s device for record keeping purposes. Cookies can be either session cookies or persistent cookies. A session cookie expires when you close your browser and is used to make it easier for you to navigate our Service. A persistent cookie remains on your device for an extended period of time. Pixels and Google Analytics: We use both pixels ( e.g. Facebook pixel ) and Google analytics to link browsing history to a device. This information may include the content you view, the date and time that you view this content, the products you purchase, or your location information associated with your IP address. This data is de-identified and is not used to personally or directly identify you. We require third parties, including Publishers, to provide notice and obtain appropriate consent, where required by applicable law.

3. How we use that information

Manage our Service, including your registration, subscriptions, and account.

Deliver the content and services that you have requested.

Respond to your comments, questions, and requests, and provide you with customer support.

Send you technical notices, updates, security alerts, information regarding changes to our policies, and support and administrative messages.

We use the information we collect to serve you more relevant advertisements ( referred to as “Retargeting” ). This is explained in more detail below in the Third Parties on our Website and Our Advertiser’s Websites section below.

Protect our intellectual property and prevent piracy of our Service.

4. Third Parties on our Website and Our Advertiser’s Websites

In order to allow SciTools™ to reach the best inventory online, we work with third party advertising companies ( our “Advertising Partners” ) to help us recognize you and serve relevant advertisements to you when you visit a website or online service in their network. We also work with Advertising Partners who help us recognize you across different devices in order to show you relevant advertisements. Our Advertising Partners may collect information about your activities on our website, our Advertisers’ websites, and other websites or online services in their networks. We also work with third party companies to assist us with website analytics such as evaluating the use and operation of our website so that we can continue to enhance the website and our services.

Technologies We and Our Third Party Advertising Partners Use

SciTools™ uses technologies such as cookies and pixels to keep track of your activities on our website and our Advertiser’s websites, and to serve you more relevant advertisements. We and our third party partners use session cookies and persistent cookies to make it easier for you to navigate and enhance the experience of our site, and to monitor and evaluate our website’s operation and use.

SciTools’s policy is that our Advertising Partners only collect information that does not personally or directly identify you via these cookies and we will cease working with partners found violating this policy. You can remove cookies by following directions provided in your Internet browser’s “help” file. You may also decline our cookies if your browser permits, but doing so may interfere with your use of our website.

5. How we share your information

We may share your information with:

Service providers under contract who help with parts of our business operations, such as fraud prevention, bill collection, marketing, and technology services.
We may share your information with service providers who assist us with serving relevant ads to you. We require by contract that our service providers only use your information in connection with the services they perform for us and not for their own benefit.
We may share aggregated non-identifiable information with Publishers or our Advertisers, such as the number of users who visit a Publisher website or the number of users who clicked on a particular advertisement. We encourage you to review the privacy policies of the website publishers that you visit to learn about their data collection practices. We do not provide information to our Advertisers about your activities. However, when you view or interact with a Retargeted ad, the Advertiser may infer that you engaged in the activities on its site that qualified you to receive the ad.

We may share information about you if necessary to comply with laws or regulations or in response to a valid subpoena, order, or government request, or to protect the rights of SciTools™ or others.

6. How we secure your information

Secure Socket Layer (SSL) encryption:

Your Personal Information is one of our most valuable assets. It is kept physically secure in our data centers and is accessible only to authorized personnel as needed to perform operations governed by this policy. In addition, when SciTools™ collects information from you, SciTools™ uses Secure Socket Layer (SSL) encryption, the industry standard for protecting privacy in web transactions. Please keep in mind that despite these measures, SciTools™ cannot guarantee or warrant 100% security of its servers and databases. Moreover, SciTools™ cannot guarantee that Personal Information that you submit through the Websites will not be intercepted.

7. Your Rights and Choices.

Your European Privacy Rights.

If you are a data subject in the European Economic Area (“EEA”), you have the right to access, rectify, or erase any personal data we have collected about you through the Service. You also have the right to data portability and the right to restrict or object to our processing of personal data we have collected about you through the Service. You may withdraw your consent at any time for any data processing we do based on consent you have provided to us.

To exercise any of these rights, contact us as set forth in the section entitled “Contact Us” below and specify which right you intend to exercise. We will respond to your request within 30 days. We may require additional information from you to allow us to confirm your identity. Please note that we store information as necessary to fulfil the purposes for which it was collected, and may continue to retain and use the information even after a data subject request for purposes of our legitimate interests, including as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements.

California Residents:

Your California Privacy Rights Under California law, our Members customers that are California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. As detailed above, we do not share our customer’s personal information with unaffiliated third parties for direct marketing purposes without their approval.

Children’s Privacy:

SciTools™ believes that it is especially important to protect children’s privacy online. SciTools™ does not knowingly collect or use any Personal Information from children under the age of 13 and SciTools™ does not knowingly provide any Personal Information, regardless of its source, to any third party for any purpose whatsoever from visitors younger than 13 years old. No information should be submitted to or posted at SciTools™ by visitors younger than 13 years old.

Your Ability to Opt-Out of Further Notifications:

Periodically, we notify our customers of new products, announcements, and updates. If you would like to opt-out of being notified, please contact us directly or use the unsubscribe button included in those communications.

Opt out of Google Analytics:

You may exercise choices regarding the use of cookies from Google Analytics by going to https://tools.google.com/dlpage/gaoptout or downloading the Google Analytics Opt-out Browser Add-on. Opting-out is generally done by the third party dropping a cookie on your browser indicating your intent to opt-out. If you get a new device, install a new browser, erase, or otherwise alter the third party’s browser cookie file, you may clear the opt-out cookie and no longer be subject to its opt-out.

Use of Website

Welcome to the SCITOOLS website. Unless otherwise specified, all Scientific Toolworks, Inc (“SciTools”) web Sites (“Web Sites”) are for your personal use. The Web Sites are provided as a service to our customers. Please review the following terms and conditions of use, which govern your use of the Web Sites (the “Agreement”).

Your use of the Web Sites constitutes your agreement to follow and be bound by the Agreement. We reserve the right to update or modify this Agreement at any time without prior notice. For this reason, we encourage you to review the Agreement whenever you use any of the Web Sites. If you do not agree to these terms, please do not use the Web Sites.


Site Transactions

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. The Web Sites and the Contents are intended solely for personal, non-commercial use. You may download or copy the Contents and other downloadable materials displayed on the Web Sites for your personal use only. No right, title or interest in any downloaded Content is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way any of the Contents or the Web Sites.


Unless otherwise specified, the Web Sites and the Contents are intended to promote SCITOOLS’s products and services available in the United States. The Web Sites are controlled and operated by SCITOOLS, INC.

SCITOOLS is pleased to hear from users and welcomes your comments regarding our products and services. SCITOOLS’s longstanding company policy does not allow us to accept or to consider creative ideas, suggestions, proposals, plans, or other materials other than those we have specifically requested. We hope that you will understand that the intent of this policy is to avoid the possibility of future misunderstandings when projects developed by SCITOOLS’s employees and agents might seem to be similar to creative works submitted by users. Accordingly, while we value your feedback, we must ask that you do not send creative ideas, suggestions, proposals, plans, or other materials for our business. If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “Comments”), you agree that SCITOOLS, INC. may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Comments that you forward to SCITOOLS. SCITOOLS is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay compensation for any Comments; or (3) to respond to any Comments. You agree that your Comments will not violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right. You further agree that your Comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Web Sites. This Agreement incorporates by reference the terms and conditions of the Privacy Policy.

Copyright Complaints


SCITOOLS respects the intellectual property of others. If you believe that your work has been copied in any way that constitutes copyright infringement, please follow our Notice and Procedure for Making Claims of Copyright Infringement.

Errors, Inaccuracies, and Omissions

Occasionally there may be information on our Web Sites that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Web Sites is inaccurate at any time without prior notice (including after you have submitted your order).

Links to Other Web Web Sites and Services

The Web Sites may contain links to other Web Sites that are not under the control of SCITOOLS. SCITOOLS has no responsibility for the linked Web Sites nor does linking constitute an endorsement of any linked Web Site. Links are provided solely for the convenience and information of the Web Sites’ users.

Disclaimer

The materials on the Web Sites are provided “as is” without warranties of any kind, either express or implied, including without limitation, warranties of title, implied warranties of merchantability, fitness for a particular purpose or non-infringement of intellectual property. SCITOOLS expressly disclaims any duty to update or revise the materials on the Web Sites, although SCITOOLS may modify the materials at any time without notice. Your use of the Web Sites is at your sole risk, and you assume full responsibility for any costs associated with your use of the Web Sites. SCITOOLS shall not be liable for any damages of any kind related to your use of the Web Sites.

Indemnification

You agree to defend, indemnify and hold SCITOOLS harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Web Sites and/or your breach of any representation, warranty, or other provision of the Agreement.

Dispute Resolution

Both you and SCITOOLS agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Web Sites, or the breach, enforcement, interpretation, or validity of this Agreement or any part of it (”Dispute”), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. Notice shall be sent

Both you and SCITOOLS agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.

Choice of Law

This Agreement shall be construed in accordance with the laws of the State of Utah, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and/or federal courts of the State of Utah, County of Washington, Utah. The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of SCITOOLS’s right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between us relating to your use of the Web Sites.

Termination

These terms are effective unless and until terminated by either you or SCITOOLS You may terminate this Agreement at any time. SCITOOLS also may terminate this Agreement at any time without notice, and accordingly may deny you access to the Web Sites, if in our sole judgment you fail to comply with any term or provision of the Agreement. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.
